Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding contract between you ("User", "you" or "your") and the Site ("Company", "we", "us" or "our"). By accessing, browsing, registering an account, making a purchase, uploading content, or using any part of the services offered on or through this site (collectively, the "Service"), you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must immediately discontinue all use of the Service operated by the Site.

Eligibility and Age Restriction

The Service is intended exclusively for individuals who have reached the age of majority in their jurisdiction of residence, which shall not be less than eighteen (18) years of age, or twenty-one (21) years of age in jurisdictions where a higher age limit is imposed by law. By creating an account or otherwise using the Service, you represent and warrant to the Site that you meet these age requirements and that your use of the Service does not violate any applicable law or regulation.

Registration and Account Responsibility

Users may be required to register an account to access certain features of the Service. You agree to provide truthful, accurate, and complete information during the registration process and to promptly update such information if it changes.

You are solely responsible for maintaining the confidentiality of your username and password and for all activities that occur under your account, whether or not you have authorized such activities. AdultPeach shall not be liable for any loss or damage arising from unauthorized use of your account.

Payments and Virtual Tokens

The Service may use a system of virtual credits or "Tokens", which may be purchased by Users through authorized payment processors. Tokens are a limited, non-transferable, and revocable license for exclusive use on the Service operated by AdultPeach.

Tokens have no inherent monetary value outside the Service and may not be redeemed, exchanged, transferred, or refunded, except as required by applicable law.

All token sales are final. Unused Tokens purchased outside of a subscription expire three (3) months after purchase. Refunds will be issued only when required by law or at the sole discretion of AdultPeach.

When purchasing Tokens, you represent and warrant that you are the legal owner or authorized user of the payment method employed and that all payment information provided is accurate and complete.

Payments are processed through third-party providers in compliance with PCI-DSS and other applicable standards. AdultPeach does not store complete payment card details.

User Content and Intellectual Property

The Service allows Users to upload, submit, generate, or provide texts, images, prompts, or other materials ("User Content").

By uploading or otherwise making User Content available to AdultPeach, you grant the Company a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to host, process, store, display, reproduce, modify, adapt, and otherwise use such User Content solely for the purpose of providing and operating the Service.

You represent and warrant that you hold all necessary rights to upload and use such User Content and that such content does not violate any applicable law or third-party rights.

Prohibited User Content includes, but is not limited to:

  • Any content involving minors or persons under eighteen (18) years of age.
  • Content depicting non-consensual sexual acts.
  • Content involving animals (bestiality), incest, or other illegal or exploitative activities.
  • Content that infringes third-party intellectual property rights, including copyrighted works, trademarks, and trade secrets.
  • Content that violates privacy or publicity rights.
  • Content otherwise prohibited by applicable legislation.

Prohibited Conduct

You shall not, directly or indirectly:

  • Use the Service for illegal or unauthorized purposes.
  • Engage in harassment, threats, abuse, defamation, or hate speech.
  • Upload viruses, malware, or any harmful or disruptive code.
  • Attempt to hack, probe, or circumvent any technical protections implemented by AdultPeach.
  • Interfere with the operation, security, or integrity of the Service.

Suspension and Termination

AdultPeach reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate your account and/or your access to the Service, with or without prior notice, for conduct that AdultPeach reasonably determines violates these Terms, infringes applicable law, or threatens the security or integrity of the Service or other Users.

Disclaimer of Warranties

The Service provided by AdultPeach is offered strictly "as is" and "as available". To the maximum extent permitted by law, the Company disclaims all warranties of any kind, whether express, implied, or statutory, including, among others, warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

Limitation of Liability

To the maximum extent permitted by law, AdultPeach shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages, including, among others, damages for lost profits, loss of data, loss of goodwill, or other intangible losses, arising from or related to use of the Service.

In no event shall AdultPeach's total liability exceed the greater of:
(i) the total amount you paid to AdultPeach for the Service in the twelve (12) months preceding the claim; or
(ii) one hundred euros (€100).

Indemnification

You agree to indemnify, defend, and hold harmless AdultPeach, its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your User Content, or your violation of these Terms.

Applicable Law and Jurisdiction

Copyright Policy and DMCA Compliance

AdultPeach respects intellectual property rights and will promptly respond to notices of alleged infringement. In compliance with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent EU guidelines, AdultPeach has adopted a repeat infringer policy. User accounts that repeatedly violate intellectual property rights may be suspended or terminated.
